This Privacy Policy explains how Lacuna (“Lacuna”, “we”, “us” or “our”) handles personal information when you use the website at lacunaart.com and related services (the “Platform”). It should be read together with our Terms of Use and Terms of Sale.

We respect your privacy and are committed to protecting your personal information. This policy describes what we collect, why we collect it, how we use and share it, and the choices and rights available to you.

For the purposes of applicable data-protection law, Lacuna is the controller of the personal information processed through the Platform, except where we process information on behalf of a Seller, in which case that Seller may be a separate controller.

2.Information we collect

Information you provide

  • Account details — name, username, email, password and, for Sellers, profile and portfolio information.
  • Profile & preferences — avatar, location, favourite styles, subjects and budget range.
  • Transaction details — orders, billing and delivery addresses, and messages with other Users.
  • Payout details (Sellers) — the information needed to remit your sale proceeds.
  • Communications — the content of enquiries you send to support or post on the Platform.

Information we collect automatically

  • Usage data — pages viewed, searches, items saved and interactions with listings.
  • Device & log data — IP address, browser type, device identifiers and timestamps.
  • Cookies — as described in section 5.

Information from third parties

We may receive information from payment processors, identity-verification and fraud-prevention providers, and analytics services, which we combine with the information above to operate the Platform.

3.How we use information

We use personal information to:

  • create and manage your account and provide the Platform’s features;
  • process orders, payments and payouts, and facilitate communication between Buyers and Sellers;
  • personalise your experience, including recommendations and search results;
  • send service messages and, where you have agreed, marketing and new-arrival updates;
  • prevent fraud, enforce our terms and keep the Platform secure;
  • analyse and improve our services; and
  • comply with legal, tax and regulatory obligations.

5.Cookies & tracking

We use cookies and similar technologies to keep you signed in, remember your preferences (such as display currency), measure how the Platform is used, and support security. You can control cookies through your browser settings; disabling some cookies may affect how the Platform works. Where required, we ask for your consent to non-essential cookies.

6.How we share information

We do not sell your personal information. We share it only as follows:

  • With Sellers and Buyers as needed to complete a transaction (for example, a delivery address shared with the Seller who ships your order).
  • With service providers who process payments, verify identity, ship artwork, host our systems or provide analytics, under contracts that protect your data.
  • For legal reasons where we must comply with law, respond to lawful requests, or protect the rights, property or safety of Lacuna, our Users or others.
  • In a business transfer such as a merger, acquisition or sale of assets, subject to this policy.

7.International transfers

Lacuna operates internationally, and your information may be processed in countries other than your own, including the United Kingdom and the European Economic Area. Where we transfer personal information across borders, we use appropriate safeguards, such as standard contractual clauses, to protect it in line with applicable law.

8.Data retention

We keep personal information only for as long as necessary to provide the Platform, comply with legal, tax and accounting obligations, resolve disputes and enforce our agreements. When information is no longer needed, we delete or anonymise it.

9.Security

We use technical and organisational measures designed to protect personal information against unauthorised access, loss, misuse or alteration. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. Please keep your password confidential and notify us of any suspected unauthorised use of your account.

10.Your rights & choices

Depending on your location, you may have the right to:

  • access a copy of the personal information we hold about you;
  • request correction of inaccurate or incomplete information;
  • request deletion of your information in certain circumstances;
  • object to or restrict certain processing, including direct marketing;

11.Children’s privacy

The Platform is intended for users aged 18 and over. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us and we will take appropriate steps to delete it.

We may update this Privacy Policy from time to time. When we make material changes we will revise the “Last updated” date and, where appropriate, notify you through the Platform or by email. Please review it periodically.
